{"id":10797,"date":"2024-10-23T17:41:26","date_gmt":"2024-10-23T17:41:26","guid":{"rendered":"https:\/\/axxessintl.com\/ehbl-amps-update\/"},"modified":"2024-10-23T17:43:22","modified_gmt":"2024-10-23T17:43:22","slug":"ehbl-amps-update","status":"publish","type":"post","link":"https:\/\/axxessintl.com\/en\/ehbl-amps-update\/","title":{"rendered":"eHBL AMPS Update"},"content":{"rendered":"<p>CIFFA met on October 15 with CBSA officials at the Commercial and Trade Branch to discuss compliance matters related to the mandatory eHBL filings by freight forwarders.<!--more--><\/p>\n<p>Following is a summary of the infractions.<\/p>\n<p><strong>C378 <\/strong>\u2013<strong>\u00a0<\/strong><em>Person failed to submit the prescribed\u00a0pre-load\/pre-arrival\u00a0information relating to their cargo\u00a0and\/or\u00a0conveyance<\/em> (Level 1 $2,000, Level 2 $4,000, Level 3 $8,000)<\/p>\n<p>Penalty amounts remain significantly high. The second quarter of this year resulted in 110 penalties being issued for a total amount of $654,000. The third quarter had 76 for a total of $338,000. CBSA advises that, of the total penalties issued, all but one occurred when filings were made post arrival, with no ACI on record.<\/p>\n<p>CBSA further wishes to remind forwarders that a cancellation\/deletion of ACI is considered a non-transmission and, in instances where clients need to make a change post arrival regarding key data elements such as the cargo control number, a BSF673 form needs to be submitted. This\u00a0process will\u00a0not result in penalties being issued.<\/p>\n<p><strong>C379 <\/strong>\u2013<strong>\u00a0<\/strong><em>Person failed to submit advance information in the prescribed time or prescribed manner to the Agency<\/em> (Level 1 $250, Level 2 $375, Level 3 $750)<\/p>\n<p>Similarly, compliance is not improving in this area, as penalties issued in the second quarter totalled 102 for $58,125. The third quarter resulted in 89 penalties being issued for $46,500. We were informed that 95.3% of infractions were related to timelines, meaning filings were made pre-arrival, but later than the legislative requirements (24 hours \u2013 marine, 4 hours \u2013 air, 2 hours \u2013 rail and 1 hour \u2013 highway).<\/p>\n<p><strong>C382 <\/strong>\u2013<strong>\u00a0<\/strong><em>Person submitted information prescribed by the\u00a0Reporting of Imported Goods Regulations\u00a0that was not true, accurate and complete<\/em> (Level 1 $500, Level 2 $750, Level\u00a03 $1,500)<\/p>\n<p>Penalties have increased for this infraction, with 25 penalties issued in the second quarter \u2013 $29,500, and 43 in the third quarter \u2013 $42,750. It has been identified that cargo description accounts for 97% of the total, with \u201cclothing\u201d and \u201cclothes\u201d being the largest contributor.<\/p>\n<p>Members should note that shipments containing clothing need to include the specific type of clothing as well as gender, as identified on the <a href=\"https:\/\/ciffa.apms5.com\/anywhere\/m?s=ciffa&amp;m=s_092fbdad-8450-4134-95d7-723a64d42105&amp;u=e1jq4wvfdtfm8dhg6n1k4hj45n2mad255mu36ha25n13ada35mt3jc1m6rtm8cj370uk8&amp;r2=d1u78w3k78qjyxvqewq66rkkc4pp2wv6ccq6ertecdgjyw3jdxkjyrb3d4ppurbed5k2uubgcnhjyrvfdnppyt1dctt6ax1dcnq6ebk8ehppr&amp;n=5\">CBSA Detailed Commodity Descriptions webpage<\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p>CIFFA is continuing to work with CBSA to address many of the shortfalls of the program. We have also requested a breakdown of foreign vs Canadian freight forwarder statistics and a summary broken down by mode.
