The Government of Canada as well as several parties from the Canadian softwood lumber industry filed notices challenging, under Chapter 10 of the Canada-United States-Mexico Agreement (CUSMA), the final results of the U.S. Department of Commerce’s latest administrative reviews of its anti-dumping and countervailing duty orders on softwood lumber from Canada.<\/p>\n

Chapter 10 of CUSMA establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a CUSMA country with review by binational panels.<\/p>\n

The latest U.S. reviews considerably raised the rates of anti-dumping and countervailing duties applied to Canadian softwood lumber imported into the United States.<\/p>\n

As part of the challenge to U.S. softwood lumber duties under CUSMA, binational panels will be established and tasked with determining whether the duty rates in question were reached in a manner consistent with U.S. law.<\/p>\n
