{"id":3528,"date":"2022-01-13T15:55:32","date_gmt":"2022-01-13T15:55:32","guid":{"rendered":"https:\/\/axxessintl.com\/?p=3528"},"modified":"2022-01-13T15:55:32","modified_gmt":"2022-01-13T15:55:32","slug":"canada-and-u-s-are-both-claiming-victory-in-cusma-trade-panels-dairy-dispute-ruling","status":"publish","type":"post","link":"https:\/\/axxessintl.com\/en\/canada-and-u-s-are-both-claiming-victory-in-cusma-trade-panels-dairy-dispute-ruling\/","title":{"rendered":"Canada and U.S. are both claiming victory in CUSMA trade panel\u2019s dairy dispute ruling"},"content":{"rendered":"<p>A dispute settlement panel issued its report under the Canada-United States-Mexico Agreement (CUSMA) regarding Canada\u2019s administration of its dairy tariff rate quota (TRQ) policies.<!--more--><span id=\"more-30053\"><\/span><\/p>\n<p>The panel agreed with the United States that Canada is breaching its commitments under CUSMA by reserving most of the in-quota quantity in its TRQs for the exclusive use of Canadian processors. United States Trade Representative Katherine Tai announced that the United States has prevailed in this first dispute settlement panel proceeding ever brought under CUSMA.<\/p>\n<p>Canada\u2019s Minister of International Trade, Mary Ng, issued a statement in response to the release of the panel\u2019s report, saying \u201cWe are pleased with the dispute settlement panel\u2019s report, which ruled overwhelmingly in favour of Canada and its dairy industry. In particular, it is important to note that the panel expressly recognizes the legitimacy of Canada\u2019s supply management system. The panel also confirms that Canada has the discretion to manage its TRQ allocation policies under CUSMA in a manner that supports Canada\u2019s supply management system.\u201d<\/p>\n<p>\u201cWe have taken note of the panel\u2019s finding regarding Canada\u2019s practice of reserving TRQ pools for the use of dairy processors.
