The Government of Canada as well as several parties from the Canadian softwood lumber industry filed notices challenging, under Chapter 10 of the Canada-United States-Mexico Agreement (CUSMA), the final results of the U.S. Department of Commerce’s latest administrative reviews of its anti-dumping and countervailing duty orders on softwood lumber from Canada.
Chapter 10 of CUSMA establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a CUSMA country with review by binational panels.
The latest U.S. reviews considerably raised the rates of anti-dumping and countervailing duties applied to Canadian softwood lumber imported into the United States.
As part of the challenge to U.S. softwood lumber duties under CUSMA, binational panels will be established and tasked with determining whether the duty rates in question were reached in a manner consistent with U.S. law.
