The Canada Border Services Agency (CBSA) initiated an investigation on November 25, 2024, under the Special Import Measures Act, respecting the alleged circumvention from Vietnam of the Canadian International Trade Tribunal’s (CITT) finding issued in February 2022 respecting the dumping and subsidizing of container chassis from China.
The investigation follows a complaint filed by a Canadian manufacturer. The complainant alleges that circumvention is occurring through assembly or completion of the goods in Vietnam, by means of insignificant process, using parts or components-that represent a major portion of the total cost of producing the like goods-originating in or exported from China.
The CBSA will investigate whether the imports are circumventing the CITT’s finding, and will make a decision within 180 days. If the CBSA finds that goods are circumventing the CITT’s findings, the CBSA will notify the CITT, and the CITT will amend its findings to extend anti-dumping or countervailing duties to the goods.
