The World Customs Organization (WCO) Secretariat released a report summarizing the findings of the “Exploratory Study on the Possible Strategic Review of the Harmonized System (HS).”
The Study reveals critical aspects influencing the health and sustainability of the HS, providing valuable insights into potential strategies for its long-term viability.
Notably, it underscores the dual roles of the HS as both a foundation for national tariff classifications and a mechanism for collecting international Customs trade statistics, highlighting the challenges of effectively balancing these functions.
Transitioning to the challenges faced, the study emphasizes the inherent difficulties in goods classification within the HS, where achieving simplicity is often elusive, particularly for an increasingly diverse range of users, including Small and Medium Enterprises (SMEs) engaged in global trade, e-commerce platforms, and amid the broader effects of globalization trends.
Moreover, the presence of subjectivity and ambiguity in the HS rules, structure, and language poses risks of reduced uniformity and heightened disputes.
Moving forward, challenges persist across various areas, including visibility, understanding, and application, leading to a prevalent lack of awareness among users and underutilization of available training programs.
Proposed solutions offer promising avenues for improvement, such as clarifying the role of the General Interpretative Rules (GIRs) within the HS text and enhancing their clarity.
Additionally, expanding training programs is crucial to improving understanding and utilization of GIRs. However, successful implementation necessitates significant resource allocation and careful coordination among stakeholders.
