A dispute settlement panel established under the Canada-United States-Mexico Agreement (CUSMA) has released it’s report regarding Canada’s dairy tariff-rate quota (TRQ) allocation measures.
The report follows the United States’ request for a dispute settlement panel on January 31, 2023, in which the United States claims that Canada’s dairy tariff-rate quota (TRQ) allocation measures deny allocation access to eligible applicants.
Two of the three panelists found that Canada’s measures do not breach of any of the CUSMA commitments that the United States cited, and one panelist agreed with a principal U.S. claim challenging Canada’s narrow definition of eligible applicants.
There is no appeal process for dispute settlements under CUSMA.
