The Canadian International Trade Tribunal initiated an expiry review of its order made in June 2021 to determine if the expiry of the order is likely to lead to continued or resumed dumping of certain whole potatoes from the United States (for use or consumption in the province of British Columbia) and if this is likely to result in injury to the domestic industry.
Under Canadian law, findings of injury or threat of injury and the associated special protection in the form of anti-dumping and/or countervailing duty expire five years from the date of the last order or finding (or its continuation) unless an expiry review has been initiated before that date.
In the first step of the review the Canada Border Services Agency (CBSA) will determine, by August 28, 2026, if there is a likelihood of resumed or continued dumping.
In the event of a positive determination by the CBSA, the Tribunal will determine, no later than February 4, 2027, whether the continued or resumed dumping is likely to result in injury to the domestic industry.
